Governor Kinuthia Mbugua yesterday won a second round of a preliminary court battle seeking to block him from running his government.
Instead, the High has this morning directed that all three petitions related to his appointees be consolidated into one case and the case be mentioned early August to fix a hearing date.
Nine nominees of the Governor County Executive Committee and its Public Service Board will therefore remain in office until then.
Nakuru resident judge Justice Anyara Emukule said he would first hear the three petitions filed by a voter John Kipng’eno, Christopher Ondieki, Joseph Chesaro Kimosoi and another by the International Centre for Policy and Conflict before deciding on the fate of the nominees.
The nominees, who were quietly sworn in last Tuesday at Nakuru Sports Club and issued with letters of appointment that Governor Mbugua who was present, signed.
It was sweet reprieve for the Mbugua camp after the judge indicated that that the three suits be filed and fixed for hearing later in November, this year.
Lawyer Ng’etich Kipkoech had claimed that Mbugua ‘was hiding behind the court order Emukule had issued barring the assembly from vetting other names to swear in the rejected nominees saying it ought to have waited for his suit to be heard.
The suit had been filed in court by Kipng’eno via lawyer Prof Tom Ojienda.
Ojienda however defended his client (Kipng’eno) saying he acted alone to protest against the assembly’s move which he termed as illegal and unconstitutional.
Lawyer Suyianka Lempaa who today representing the civil society urged the court to block the nine officials from taking officials saying the move by the governor was illegal since the nine had been rejected by the assembly.
But the court declined to issue an injunction against the Governor and his government although he certified the issues raised as urgent.
